These Terms of Use (“Terms”) govern your access to and use of hoacapital.co (the “Site”) and the eligibility-matching service offered by HOA Capital (“HOA Capital,” “we,” “us,” or “our”). Please read these Terms carefully before submitting the eligibility form or otherwise using the Site.

Acceptance of terms

By accessing the Site or submitting information through our eligibility form, you agree to be bound by these Terms. If you do not agree, do not use the Site or submit information to us.

Description of the service

HOA Capital operates an informational and matching service for Florida condominium and homeowners associations exploring funding options for structural inspections, milestone repairs, SIRS reserves, and other capital projects. We collect information about your association and share it with institutional lending partners so they can evaluate potential eligibility. HOA Capital is not a lender, is not a broker of record, and does not provide financial, legal, engineering, or investment advice. We do not guarantee that any association will be approved for funding, receive an offer, or qualify for any particular rate or term. Eligibility, underwriting, terms, and approval decisions are determined solely by our lending partners, in their sole discretion, and may change at any time.

Accuracy of submitted information

You represent that any information you submit through the Site is accurate and that you are authorized — as a board member, authorized officer, community manager, or other individual with the association’s permission — to submit that information and to be contacted on the association’s behalf regarding funding options. HOA Capital and its lending partners rely on the accuracy of the information you provide and are not responsible for decisions made based on inaccurate or incomplete submissions.

Intellectual property

The Site and its content — including text, graphics, logos, and design — are owned by or licensed to HOA Capital and are protected by intellectual property laws. You may view and use the Site for your own personal or association-related purposes, but you may not copy, reproduce, distribute, or create derivative works from the Site or its content for any other purpose without our prior written permission.

Third-party services

The Site relies on third-party service providers to operate — including hosting and database infrastructure, a customer-relationship-management platform, email delivery, and advertising and analytics platforms — and may reference or link to services operated by our lending partners. We do not control and are not responsible for the content, terms, or practices of any third-party service, and your use of any third-party service is subject to that provider’s own terms.

Disclaimers and limitation of liability

The Site and our matching service are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any submission will result in a funding offer or approval. To the extent permitted by Florida law, HOA Capital and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of funding, revenue, or data, arising out of or relating to your use of the Site or our service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed one hundred dollars.

Indemnification

You agree to indemnify and hold HOA Capital harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submission of inaccurate or unauthorized information, or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Changes to these terms

We may update these Terms from time to time. Changes take effect when posted to this page with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
